FORMER Special Assistant to the President for press and public relations Amos Chanda has appealed against the one year jail term imposed on him.
Lusaka magistrate Irene Wishimanga jailed Chanda for 12 months after finding him guilty of stealing a court record at the Lusaka Magistrate’s Court sometime in 2022.
Chanda is not happy with the judgement and has now filed a notice to appeal.
He has also applied that the court grants him bail pending hearing of an appeal.
Chanda submits in his five grounds of appeal, he contends that the learned magistrate misdirected herself in law a when she convicted him of the offence of theft and destruction of evidence.
The appallent adds that there wasn’t sufficient evidence tendered by the prosecution warranting the conviction.
“The trial magistrate erred in law and fact when she avoided the evidence of the prosecution which clearly warranted the fact that there was no record stolen".
Chanda contends that the magistrate erred in law when it filled in the gaps by introducing evidence on record when there was no proof showing that the accused stole the record.
He adds that the court erred in law and fact when it proceeded to convict him on a tempered piece of evidence.
“The court below erred in law and fact when it convicted the appellant based on a piece of evidence that was tempered with and fully discredited,” the document reads.
This is the second appeal Chanda has filed in the Lusaka HIgh Court.
He recently appealed against the seven months imprisonment imposed on him in March this year for using insulting language against Anti-Corruption Commission officers.
